Preamble

These General Terms of Use define the conditions in which Users shall use the Recruitment Service. The use of or access to the Service implies unconditional and unlimited acceptance of these General Terms of Use.

If you do not agree with the provisions of the General Terms of Use presented below, please do not use the Service.

1. DEFINITIONS

“General Terms of Use” means the present General Terms of Use applicable to the APRIL GROUP Recruitment Service.

“Service Editor” or “Editor” means APRIL GROUP, as per Article 13 hereinafter.

“APRIL GROUP” or “APRIL” means all the companies authorized to put information on line in the Service or to access the information provided on line by Users of the Service and thus includes APRIL GROUP, its subsidiaries and sister companies.

“Recruitment Officer(s)” means any person from APRIL GROUP or appointed to act on behalf of an APRIL GROUP company, duly authorised by the Service Editor to put job offers on line as part of the Service and/or to use job applications provided by Users for APRIL GROUP recruitment campaigns.

“Service” means the service enabling Users to consult APRIL GROUP job offers, to reply to them or to submit an unsolicited application on line.

“Site” means the website from which the User accesses the Service, and particularly the following website: http://www.aprilgroup-recrute.com. In the future, other sites may be used to access the Service.

“User” means any person using the Service.

2. DESCRIPTION OF THE SERVICE

The Service enables Users to consult job offers proposed by APRIL GROUP Recruitment Officers, to reply to such offers or to submit an unsolicited application.

Notification of application receipt shall be sent immediately to the email address indicated by the User, and particularly when the User has replied to a job offer from APRIL GROUP. APRIL GROUP reserves the right to contact, at a later date, any User whose profile subsequently matches a request made by APRIL GROUP Recruitment Officers, in accordance with the job applications retention period defined in Article 5.2 and provided that the User in question has not asked APRIL GROUP to delete his personal data.

The Service also enables Users who so desire to receive the new job offers within APRIL GROUP by email, according to the criteria predetermined by the User.

3. SCOPE

The Service aims solely to provide Users and APRIL GROUP Recruitment Officers with a dedicated contact tool, but on no account is this tool intended to manage the recruitment of Users. The recruitment process to which the contact made possible by the Service may give rise shall be governed by conditions distinct from these General Terms of Use and shall be conducted under the sole responsibility of the relevant Recruitment Officer(s) within APRIL GROUP.

4. USE OF THE SERVICE

When asked for information, Users undertake to provide updated and accurate information.

Users undertake not to copy, amend or alter nor attempt to copy, amend or alter in any manner whatsoever the content or IT programming of the Site pages that permit access to and use of the Service.

Users undertake to comply with all the regulations applicable in the country in which they use the Service and, in particular, they undertake not to submit any document, data or information that is defamatory or insulting, infringing, unlawful, incorrect or falsified or that is not in keeping with public policy and good moral standards or with the IT operation of the Site or Service.

The Service Editor reserves the right to delete any application which is manifestly not in keeping with public policy and good moral standards and to take legal action against any User who has acted in a manner likely to infringe these provisions or the laws and regulations in force.

5. USER DATA

5.1 Purpose of data collection from Users

Personal data is collected from Users solely to enable the APRIL GROUP Recruitment Officers to compare the Users’ profiles with the requirements of the vacant positions.

Data that is essential to examine the replies or unsolicited job applications is preceded by an asterisk. If no answer to these compulsory questions is provided, the application cannot be studied. The other personal data requested is optional.

Under no circumstances shall the answers to the questions asked as part of the Service or the failure to answer to optional questions give rise to any discriminatory treatment by APRIL GROUP within the framework of the Service. Similarly, the questions that the Users must answer as part of the Service shall not under any circumstances give rise to any discriminatory treatment by APRIL GROUP. Such data shall only enable APRIL GROUP to subsequently contact Users in a relevant and personalised manner as part of the Service.

The User’s application shall be accessible to all the APRIL GROUP entities interested in his/her profile, located in the Territory or outside the European Union. Where appropriate, the application may also be transmitted to Recruitment Officers external to APRIL GROUP for the purpose of applicant screening procedures. By replying to a job offer or submitting an unsolicited application, the User agrees to any such transmission. In all cases, the data supplied by the User shall only be used to study his/her application for a vacancy offered by APRIL GROUP and for recruitment procedure purposes. Such data shall never be assigned or disclosed for other purposes.

5.2 User data confidentiality and protection guarantee

In accordance with the French Data Protection and Civil Liberties Act No. 78-17 dated 6th January 1978 and, in Europe, with EC directive 95/46 dated 24th October 1995 on the protection of personal data and privacy, the User may request access to or the modification, rectification or deletion of his/her personal data kept by APRIL GROUP in the context of the Service by sending a letter together with proof of his/her identity and indicating his/her address, to the following address: APRIL GROUP, Direction des Ressources Humaines 83-85 boulevard Marius Vivier Merle - 69487 LYON Cedex 03.

Personal data collected via the Service shall be only kept by the Service Editor for a limited period of time:

- For interns and VIEs (international volunteers scheme) (Note: VIE offers are reserved for nationals of European Union countries), for a period of 6 months;
- For Junior profiles, for a period of 12 months;
- For Senior profiles, for a period of 12 months.

However, Users are reminded that they may, at any time, ask for their personal data to be deleted in the conditions set forth above.

The Service Editor does not warrant that no copy of such data shall be kept by APRIL GROUP companies for a longer period of time, under their sole control and liability.

The Service Editor undertakes to use state-of-the-art means to avoid any data corruption or breach of confidentiality by unauthorised third parties. However, due to the technical characteristics of the network, the safety, confidentiality or integrity of data transmitted via the Internet cannot be guaranteed by the Service Editor.

6. COOKIES

Cookies are small files that are temporarily saved in a predetermined repository of the User’s computer. The Site Editor uses cookies files in order to obtain anonymous statistics about use of the Service. On no account does the Editor use any cookies that could enable the User to be identified by the Editor.

In any case, the User can configure his/her computer so that these cookies files are systematically refused by his/her browser or expressly authorised by the User. For practical information about the options available in the browser, Users are invited to read the “Your traces” section on the French personal data protection authority’s website at: http://www.cnil.fr.

7. INTELLECTUAL PROPERTY

The Website pages used to access the Service, as well as all the component elements or those implemented for the Service to run, particularly photographs, images, animations, software, interfaces, trademarks, logos, texts, drawings, icons, illustrations (hereinafter collectively referred to as the “Data”) are protected by intellectual and industrial property law worldwide.

Generally speaking, access to the Service does not grant the User any prerogative over the intellectual property rights relating to the Data which remain the exclusive property of APRIL GROUP or, if appropriate, of third parties.

The User is authorized to copy the job offers accessible via the Service for personal information and strictly private use only. In all other cases, the User is not authorized to copy, reproduce, represent, modify, translate, create derivative products, or distribute all or any part of the Data or use them in any other manner outside the Service.

In accordance with applicable laws, the User may be held liable under civil or criminal law for any illegal or unauthorized use of the Data.

8. DATABASE

The Service uses a database containing the information about User applications and the jobs offered by APRIL GROUP (hereinafter referred to as the “Database”).

This Database is the exclusive property of the Service Editor.

In accordance with the laws of France, the Users of the Service undertake not to infringe the Service Editor’s intellectual property rights relating to the Database and undertake in particular not to substantially or systematically extract data or to use data for purposes that are not strictly personal and non commercial.

Users undertake not to access the Database content other than via and in the manner intended by the Service.

9. LIMITATIONS OF LIABILITY

The Service Editor does not control the job offers made available on the Service by the Recruitment Officers under their sole responsibility.

9.1 The Service Editor makes the User’s application available to the Recruitment Officers. However, there is no guarantee that the User’s application shall be considered by the latter or even that the User will be contacted by a Recruitment Officer to take part in a recruitment procedure.

9.2 The Service Editor does not control the screening and recruitment process used by the different entities of APRIL GROUP and/or by the Recruitment Officers where applicable. Therefore, the Service Editor disclaims all liability with respect to the use that might be made of the data transmitted by the User via the Service by the various entities of APRIL GROUP or by the Recruitment Officers during the recruitment process, and particularly in the event that said data is used in a manner contrary to the legislation in force in the country in which the recruitment process is held.

9.3 APRIL GROUP gives no undertaking with regard to the hypertext links that enable the User to access other Websites, neither does it undertake to check such links or the content of the sites to which they direct the User. The inclusion of a link to another site shall not imply either the approval of said other site by APRIL GROUP, or the approval of the products and services contained in such sites by the latter. APRIL GROUP therefore disclaims all responsibility for the content or the privacy protection policy of the Websites to which such hypertext links direct the User.

9.4 Given the technical vagaries of the Internet, the Service Editor cannot guarantee the continuous operation of the Service and shall not be held liable for any interruption, suspension, malfunction or bugs in the Service, or for any alteration, destruction or loss of data provided by the Users. The User also acknowledges that the Service may be interrupted for maintenance operations. Furthermore, the Service Editor shall not be held liable for any difficulty in accessing or using the Service resulting from malfunction or unavailability of the Site through which the User accesses the Service if the Site is operated under the control of an entity other than APRIL GROUP.

9.5 The Service Editor reserves the right to change or temporarily suspend or stop all or any part of the Service at any time, with or without notice. The Service Editor shall not be liable to the User or to any third parties for any change, suspension or stoppage of the Service.

10. FORCE MAJEURE

The Service Editor shall not be held liable for any injury, damage or loss caused by a force majeure event as recognised by French case law.

11. CHANGES TO THE GENERAL TERMS OF USE

The Service Editor reserves the right to change all or any part of these General Terms of Use at any time, with or without notice.

The changes shall become effective as soon as they are put on line.

The User must therefore regularly review the provisions of the General Terms of Use. The mere fact of continuing to use the Service implies the User’s acceptance of any changes to the General Terms of Use.

12. RULES OF EVIDENCE

It is expressly agreed that all the data, information, files and any other digital items exchanged between the User and the Service Editor or kept by the latter namely in its databases or on its servers, shall constitute admissible, valid and enforceable evidence that carry the evidential weight of a deed made under private seal.

The User undertakes not to challenge the admissibility, validity, enforceability or evidential weight of the abovementioned electronic items, on the grounds of their electronic nature. Unless proven otherwise, such items shall be valid and enforceable in the same way, under the same conditions and with the same evidential weight as any document draw up, received or held in writing.

13. LANGUAGE

In the event of any discrepancy between the French and English versions of these General Terms of Use, only the French version shall be taken into account to construe the terms hereof.

14. SEVERABILITY

If one or more provisions of these General Terms of Use are considered invalid or are declared as such pursuant to a law, rules or further to a final decision made by a competent jurisdiction, the other provisions shall retain their full force and scope.

15. GOVERNING LAW

The General Terms of Use and the Service are governed by the laws of France. Any dispute arising out of or in connection with the construction or performance of the General Terms of Use or relating to the performance of the Service shall be brought before the Commercial Court of LYONS, France.
